Applewood West Holdings wants to build an active adult community that would include up to 400 homes on the Golden, Colo., golf course. In the suit, the Applewood Property Owners Association is arguing that development is prohibited under the Minerals Preservation Act.
A plan to build hundreds of homes on Applewood Golf Course in Golden, Colo., is moving forward, though the Applewood Property Owners Association has filed a lawsuit in an attempt to stop the development, the Denver-based KWGN-TV reported.
The developer, Applewood West Holdings, wants to build an active adult community for people 55 and older. The community would include 300-400 homes with open space and trails, KWGN-TV reported.
A lawsuit filed on July 24th by the Applewood POA argues that development can’t happen under the Minerals Preservation Act, KWGN-TV reported.
Under the statute, rezoning areas containing a known commercial mineral deposit “in a manner which would interfere with the present or future excavation of such deposit by an extractor” violates Colorado law, KWGN-TV reported.
“I think the statute is going to shut him (the developer) down,” said Kathy Lower. “Plus, the whole thing about an active adult community limited to people who are 55 is not enforceable by law.”
A group of neighbors against development say the land the golf course sits on is not suitable for housing due to the high potential of flooding, KWGN-TV reported.
