Michael DeRosa filed a lawsuit over his 10% commission after the Auburn, N.Y., club was sold to one of its members in late 2015 prior to the expiration of DeRosa’s contract to sell the property. The court also awarded interest and legal fees.
A court has awarded real estate broker Michael DeRosa a $124,300 judgement against the Owasco Country Club in Auburn, N.Y., the Syracuse (N.Y.) Post-Standard reported.
The judgement was awarded in a state Supreme Court ruling issued this week which upheld an arbitrator’s decision, said Al Fazio, lawyer for DeRosa, who runs the Michael DeRosa Exchange with offices in Auburn and New York City, the Post-Standard reported.
DeRosa filed a lawsuit over his commission after the Owasco Country Club sold the club to one of its members in late 2015 prior to the expiration of DeRosa’s contract to sell the property, Fazio said.
The lawsuit claimed that DeRosa was entitled to the brokerage commission on the sale of the property, which took place in December 2015, Fazio said. The property sold for $883,000 and Fazio said DeRosa was entitled to 10 percent of that, the Post-Standard reported.
The contract called for arbitration, and an arbitrator’s ruling in DeRosa’s favor was then filed with state Supreme Court to be transferred into a judgement, Fazio said. The court awarded interest and legal fees, amounting to $124,300, the Post-Standard reported.
Club member Gerald Crowley took over the club late in late 2015. A corporation that Crowley established for the business, Owasco Golf & Tennis Club LLC, purchased the East Lake Road property for $883,023. Crowley had bought out the mortgage holder on the property, the Post-Standard reported.
