The Downingtown, Pa., club filed a lawsuit against Pulte Homes for breach of contract in 2012, alleging that the developer refused to complete a housing project at the property, costing the club millions in lost revenue and profits from memberships. Pulte asserted that it never agreed to build 1,000 homes.
A Common Pleas Court jury ruled in favor of Applecross Country Club in Downingtown, Pa., over an unfinished housing development, the West Chester, Pa.-based Daily Local News reported.
The $20 million verdict, delivered after several hours of deliberations and more than two weeks of trial, came in favor of Applecross Club Operations, a member of the Talamore Family of Country Clubs, and against Pulte Homes, the News reported.
In September 2012, the golf course filed a lawsuit against Pulte for breach of contract. It alleged that Pulte induced the corporation to purchase and operate a champion golf course and luxury country club facilities by promising to build over 1,000 residential homes in a planned community sprawling across two townships in Chester County, East Brandywine and West Brandywine Township, the News reported.
But fewer than two years after Applecross acquired the golf and country club, Pulte decided it could not complete a large number of the planned homes community in West Brandywine, including 375 residences. Applecross alleged that Pulte’s refusal to finish the project cost Applecross millions of dollars in lost revenues and profits from country club memberships, the News reported.
Pulte asserted that it never agreed to build over 1,000 homes, and never agreed to build the portion of the community in West Brandywine Township. Prior to the trial, Mahon found that the written agreements between Applecross and Pulte were ambiguous because of a key missing exhibit that defined and described the community Pulte agreed to build, the News reported.
The jury eventually found that there was a written agreement that Pulte would build the homes, including those in West Brandywine Township, the News reported.
