The St. Paul (Minn.) City Council has approved a settlement agreement with the Town and Country Club over a lawsuit the club filed to stop the city from building a sidewalk along its property, reports the Minneapolis Star-Tribune.
The 120-year-old club, which sits on the north side of Marshall Avenue near the Mississippi River, sued the city in May after receiving a $43,000 assessment for a new sidewalk.
The city had approved a $600,000 project that includes installing medians on Marshall, adding a bicycle lane and putting in the sidewalk on the north side of Marshall where there’s now a dirt path. Most of the money for the project comes from a federal grant.
The Town and Country Club claimed the city didn’t inform the club about wanting to build the sidewalk and cited concerns about losing trees, public safety and paying for a project that it said wouldn’t benefit its property value.
The city denies those claims.
Among the settlement terms:
- The city will proceed with building the sidewalk.
- Town and Country will not be assessed.
- The city will pay for removing and replacing part of a fence.
- The city will replace trees.
